Terms & Conditions of Sale

1. Order Acceptance, Pricing & Availability

All prices on `www.burhaniprotech.com` are displayed in United States Dollars (`USD`). Formal quotes generated through our RFQ Desk or CTO Server Configurator are valid for thirty (30) calendar days unless otherwise noted. In the rare event of a typographical error, upstream OEM distributor price revision, or stock allocation constraint, Burhani Pro Tech reserves the right to notify the buyer prior to shipment for confirmation or immediate full cancellation/refund at zero cost to the buyer.

2. Payment Terms (Federal Net-30 PO vs. Commercial Checkout)

• Federal Government Buyers: Verified U.S. Federal Agencies, DoD commands, and authorized prime contractors qualify for Net-30 Days payment terms from the date of invoice/delivery in accordance with the Prompt Payment Act (`FAR 52.232-25`).
• Commercial Buyers: Commercial orders require payment authorization at checkout via Credit Card or Wire/ACH Transfer prior to warehouse dispatch unless a written corporate Net-30 credit line has been pre-approved by Burhani Enterprises Inc.

3. 7-Day (1-Week) Return & RMA Policy

Returns and exchanges are governed strictly by our 7-Day (1-Week) Return & RMA Policy. Claims must be submitted within 7 calendar days of carrier delivery and are accepted exclusively for: (a) Defective or Dead-on-Arrival (DOA) hardware, or (b) Wrong product/SKU shipped due to warehouse or fulfillment error. Eligible returns receive a 100% free prepaid return shipping label, $0 restocking fee, and priority replacement or full refund. Non-defective, buyer's-remorse, or opened/activated software orders are final sale and non-returnable.

4. Custom Configure-to-Order (CTO) Servers & Software Licenses

Custom Configure-to-Order (CTO) rack servers built via `/configurator` (custom CPU, RAM, RAID, and GPU assemblies) and Electronic Software Delivery (ESD) / Volume License keys (including Microsoft Windows 11, Windows Server 2025, M365, VMware, Red Hat, Fortinet, and Palo Alto subscriptions) are provisioned specifically for the buyer's organization and cannot be canceled or returned once assembly has begun or license keys have been issued, except in the event of verified DOA hardware defect within 7 days of delivery.

5. OEM Manufacturer Warranties & Limitation of Liability

All products sold by Burhani Pro Tech are 100% genuine, factory-new products sourced through authorized Tier-1 OEM distribution channels and include the full standard OEM manufacturer warranty (typically 1-Year to 5-Year Next-Business-Day ProSupport/SmartNet depending on SKU). Beyond our 7-Day DOA/Wrong-Item Return guarantee, post-7-day hardware warranty service is provided directly by the OEM manufacturer. To the maximum extent permitted by law, Burhani Guards Pro Tech LLC's total aggregate liability on any claim shall not exceed the purchase price paid for the specific product giving rise to the claim, and in no event shall Burhani Pro Tech be liable for indirect, incidental, consequential, or lost-profit damages.

6. Export Control (EAR / ITAR), NDAA Section 889 & Governing Law

Buyer agrees to comply with all U.S. Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), and OFAC sanctions laws. Hardware, cryptographic modules (FIPS 140-3), and enterprise AI GPUs purchased from Burhani Pro Tech may not be exported or re-exported to embargoed destinations or restricted entities. Commercial transactions are governed by the laws of the State of Illinois (venue in Cook County, IL); Federal Government contracts are governed by applicable U.S. Federal procurement law (`FAR` / `DFARS`).
